Introduction

Welcome to Mining Mart Store. These Terms of Service (the "Terms") govern your access to and use of Mining Mart Store websites, applications and related services (collectively, the "Services").

Payment and billing may be processed by third-party providers; you may manage or cancel subscriptions via their customer portal where enabled.

Use of the Services

You agree to use the Services only for lawful purposes and in compliance with these Terms and applicable laws. You will not attempt unauthorized access, interfere with the Services, reverse engineer except as allowed by law, or use the Services for unlawful content. We reserve the right to investigate and take action against abuse.

User Content and Intellectual Property

You retain ownership of content you submit. By submitting content you grant Mining Mart Store a worldwide, non-exclusive, royalty-free license to host, store, reproduce and display that content as reasonably necessary to provide and improve the Services.

All intellectual property rights in the Services, the Mining Mart Store name, logos and other content are owned by Mining Mart Store or its licensors. You may not copy, modify, distribute, sell or create derivative works except as expressly authorized.

Third-Party Services and Integrations

The Services may integrate with third-party products and services subject to the third party's terms. Mining Mart Store is not responsible for availability, functionality or security of third-party services.

Data Protection and Privacy

Our Privacy Policy describes how we collect, use and disclose personal data. Enterprise customers may request a Data Processing Agreement (DPA).

Security and Compliance

We implement industry standard measures to protect data, including encryption in transit and at rest. We cannot guarantee absolute security; you agree to use reasonable precautions to protect credentials and data.

Warranties and Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINING MART STORE DISCLAIMS ALL WARRANTIES. MINING MART STORE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR COMPLETELY SECURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINING MART STORE AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES WILL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS (AUD 100), WHICHEVER IS GREATER.

Indemnification

You agree to defend, indemnify and hold harmless Mining Mart Store and its affiliates from and against any third-party claims arising from your use of the Services, your violation of these Terms or applicable law.

Termination and Suspension

We may suspend or terminate your access at our discretion. You may terminate your subscription at any time. On termination, your right to access data may be limited; please export needed data before termination.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA. Any disputes will be resolved in the courts located in that jurisdiction. If you are a consumer in a jurisdiction that prohibits such choice, your local law may govern.

Changes to These Terms

We may modify these Terms from time to time. Material changes will be communicated by email or by a notice on the Services. Continued use after the effective date means acceptance of the updated Terms.
